General Terms and Conditions

§ 1 Scope and Provider

  1. These General Terms and Conditions apply to all orders placed through the online shop of Berlin Çiğköfte – Adiyaman Çiğköfte, Herrfurthstr. 32, 12049 Berlin, Germany.

  2. The product offerings in our online shop are exclusively directed at buyers who have reached the age of 18.

  3. Our deliveries, services, and offers are made solely on the basis of these Terms and Conditions. These Terms and Conditions also apply to companies for all future business relationships, even if not explicitly agreed again. The inclusion of any general terms of a customer that contradict our Terms and Conditions is hereby expressly rejected.

  4. The contract language is exclusively German.

  5. You can access and print the currently valid Terms and Conditions on our website [insert link]. The contract text will not be stored.


§ 2 Conclusion of Contract

  1. The presentation of goods in the online shop does not constitute a binding offer to conclude a purchase contract, but an invitation to place an order.

  2. By clicking the button [“Order now with obligation to pay” / “Buy”], you submit a binding purchase offer (§ 145 BGB). Immediately before placing the order, you can review and, if necessary, correct your order.

  3. Upon receipt of the purchase offer, you will receive an automatically generated email confirming that we have received your order (order acknowledgment). This confirmation does not yet constitute acceptance of your offer.

  4. A purchase contract is concluded only when we expressly declare acceptance of the offer (order confirmation) or when we deliver the goods to you without prior explicit acceptance. If multiple alternatives occur, the contract is concluded at the time the first alternative occurs. Your offer can only be accepted until the time you could reasonably expect a response (§ 147 Abs. 2 BGB). Exception: for advance payment and PayPal, the order is accepted immediately upon submission.

  5. Orders are only possible in quantities typical for households.


§ 3 Prices

The prices listed on the product pages include statutory VAT and other price components and are exclusive of shipping costs. A deposit is charged for all disposable beverage containers subject to a deposit. This deposit will be refunded upon return of the empty containers. You can also return the bottles at a collection point. Please note that you must bear the return shipping costs yourself.


§ 4 Payment Terms; Default

  1. Payment can be made by invoice, credit card, PayPal, or direct debit.

  2. We reserve the right to offer only selected payment methods, e.g., advance payment to secure credit risk.

  3. For credit card payments, the purchase price is reserved (authorized) at the time of order; actual billing occurs when the goods are shipped.

  4. For PayPal payments, you will be redirected to PayPal to authorize the payment. Payment is executed automatically by PayPal after order submission.


§ 5 Set-off; Right of Retention

  1. You may only offset claims if your counterclaim is legally established, undisputed, or closely related to our claim.

  2. You may only exercise a right of retention if the counterclaim arises from the same contractual relationship.


§ 6 Delivery

  1. Unless otherwise agreed, delivery is made from our warehouse to the address provided by you.

  2. Deliveries are only possible within Germany, excluding the German islands for fresh or refrigerated goods.

  3. Partial deliveries are permitted if reasonable. Delivery deadlines start upon receipt of the last partial delivery.

  4. For perishable goods, the customer must ensure acceptance at the agreed delivery date.

  5. For loose goods sold by weight (e.g., fruits, vegetables, meat, cheese), minor deviations in quantity may occur. Prices are calculated based on the unit price.

  6. Delivery is subject to availability. If a product is unavailable, we will inform you of the expected delivery date or propose a comparable product. Payments already made will be refunded if no suitable alternative is chosen.

  7. Alcohol, tobacco, or legally restricted items are delivered only to recipients who meet legal requirements and present ID.

  8. We are not obliged to deliver if we are not properly supplied ourselves (congruent coverage transaction).


§ 7 Retention of Title

  1. Goods remain our property until full payment.

  2. For entrepreneurs (§ 14 BGB):

    • We retain title until all claims from the business relationship are settled.

    • You may resell goods in the ordinary course of business; proceeds are assigned to us.

    • In case of processing, we acquire co-ownership proportionate to the invoice value.

    • We will release securities exceeding the secured claim value by more than 10% upon request.


§ 8 Right of Withdrawal

Consumers (§ 13 BGB) have the right to withdraw from the contract within 14 days without giving reasons.
The withdrawal period is 14 days from receipt of the goods. To exercise this right, notify us:

Consequences: We will refund all payments including standard delivery costs within 14 days. You bear the costs of returning the goods. Liability for diminished value only applies if the goods were handled beyond necessary inspection.

Exceptions: Withdrawal does not apply to:

  • Custom-made goods, perishable goods, sealed hygiene products if opened, goods inseparably mixed after delivery, alcohol delivered after >30 days.

Return instructions: Avoid damage; use original packaging or protective packaging; notify by phone before return.


§ 9 Transport Damage

Report obvious transport damage immediately to the carrier and contact us. Failure to report does not affect your statutory warranty rights.


§ 10 Warranty

  1. Warranty claims follow statutory provisions (§§ 433 ff. BGB).

  2. For entrepreneurs:

    • Only our product descriptions are binding.

    • Inspect goods immediately and report visible defects within 7 days.

    • Warranty remedy: repair or replacement.

    • Warranty period: 1 year from delivery.


§ 11 Liability

  1. Unlimited liability for intent, gross negligence, and under the Product Liability Act. For slight negligence, liability exists only for injury to life, body, or health.

  2. Otherwise, liability for slight negligence is limited to foreseeable damages from essential contractual obligations (cardinal duties).


§ 12 Alternative Dispute Resolution

The EU Commission provides a platform for out-of-court dispute resolution: http://ec.europa.eu/consumers/odr/. We are not obliged to participate in such procedures.


§ 13 Final Provisions

  1. Invalid provisions do not affect the validity of other provisions.

  2. German law applies exclusively, excluding the CISG. Mandatory consumer protection laws of the consumer’s habitual residence remain unaffected.

  3. For merchants, public law entities, or special public assets, the court of our business location has jurisdiction.
